Terms of Business — For Businesses (Hirers)

These terms apply when EXPND introduces a candidate to you directly. They're provided in line with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

They do not apply to roles posted by partner agencies. Some listings on this site are posted by independent agencies operating their own deal flow. Those are marked as posted by a partner agency, and everything about them — the fee, the terms, any replacement arrangement, and the relationship itself — is agreed directly between you and that agency. EXPND is not a party to it, takes no fee from it, and gives no guarantee in respect of it.

1. Our role

EXPND acts as an Employment Agency in relation to you — we introduce candidates to you for direct, permanent placement into your business. The candidate becomes your employee (or is otherwise directly engaged by you), not an employee of EXPND. We do not supply candidates to you on a temporary basis as an Employment Business. [A solicitor should confirm this in writing before launch, particularly if any future placements are structured as temporary/agency-employed rather than direct permanent placement, as that would require different wording.]

3. The 90-day replacement

This applies only to candidates EXPND places with you directly. It does not extend to anyone you hire through a partner agency's listing — see the note at the top of these terms.

If a candidate we placed doesn't work out within their first 90 days, we'll source a free replacement, with no limit on replacements within that window. It does not entitle you to a refund of fees already paid; replacement sourcing is the sole remedy.

4. Our vetting process

We assess and put forward candidates based on the role requirements you provide. While we take care in matching, EXPND does not guarantee the performance of any placed candidate beyond the replacement set out above — the employment relationship and day-to-day management responsibility is yours as the employer.

Candidate information shared with you is provided solely for the purpose of considering them for your role and must not be shared further without their consent.

7. Ending our relationship

Either party may end the business relationship at any time by written notice, without affecting fees already due for placements made prior to termination.

8. Complaints

Contact us at support@expnd.co.uk in the first instance. Unresolved complaints can be escalated to the Employment Agency Standards Inspectorate (GOV.UK).

9. Governing law

These terms are governed by the laws of England and Wales.
